Visa Administrative Review

If you are refused a UK visa under the points based system (work and student migrants) you can only appeal the decision on race discrimination and/or human rights grounds.

In most cases, the main remedy will be an administrative review and not an appeal, which means UKBA will review their decision and look at the assessment of your points. Dependants of Points Based Applicants cannot request an administrative review but should appeal if they have a right of appeal (see the appeals section here).

The decision and refusal notice UKBA sends you will include an administrative review request notice and guidance notes to go with this request notice. You can also download these documents from UKBA’s website. If you want to request a review then you must do so no more than 28 days after you receive the refusal notice.

You should complete the notice request and send it to the address which will be on the notice. You should not send any additional documents. If the decision is overturned you will be asked to send your passport or travel document.

Requesting a review is free of charge, you can however only request one review per decision. A review will take up to 28 days and you will be notified of the decision in writing.
